RERA Portal linked with Bank Portal for quick transfer of money recovered against the RCs to allottees

Lucknow| U.P. RERA facilitates the recovery of the amount due to the allottees from the promoters through recovery certificates (RCs) and, as and when the recovered money is received from the District Magistrate, the allottee is required to submit an affidavit in RERA. The money is transferred into the account of allottee on receipt of this affidavit. U.P. RERA has issued a detailed and revised S.O.P. in this respect on 10-09-2024 to minimize the duration of transfer of money to allottees, which can be seen on its portal.

According to the earlier arrangements, after clearance of D.D. or cheque in the bank, the letter is being sent to the complainant via post. The new arrangement has been implemented to minimize the duration of the entire process. As per the new arrangement, the bank, on clearance of the D.D. or Cheque, will update the details of the recovered money on its software which will be instantly updated on the portal of U.P. RERA through API (Application Programming Interface). An e-mail will instantly go to the allottee from U.P. RERA portal requiring him to file a notarized affidavit on non-judicially stamp paper of Rs. 10 in the prescribed format attached with this e-mail.

This affidavit is crucial for transfer of money to the complainant and, therefore, it is expected of him that he would file this affidavit quickly and correctly. Through this affidavit, the complainant is required to give the details of his bank account or joint bank account in case of joint allotment, details of amounts received from the promoter, if any and also the details of the injunction orders from the competent court, if any. The complainant is also required to disclose the details of bank loan, if any, along with undertaking to re-pay such bank loan. The allottee has also to file a copy of the pass book or canceled cheque as proof of the bank account details.

The allottee must file this affidavit through speed post or in person at U.P. RERA Lucknow Headquarter or Greater Noida office promptly and in original. He must also upload a scanned copy of the affidavit through his log-in on the portal of U.P. RERA. It is not uncommon for the District Magistrates to recover the amounts against the RCs in parts, especially in case of large-amount RCs. However, the allottee is required to file this affidavit only once, when the first installment of money is received. These instructions will apply in the matters of transfer of money received through the Appellate Tribunal also.

It was stated by Sanjay Bhoosreddy Chairman, U.P. RERA that U.P. RERA is firmly resolved to render prompt justice to the allottees and is continuously working to streamline the processes to quickly pass on the fruits of the orders of RERA to such allottees. RERA has taken API from the concerned bank to facilitate prompt transfer of money received from the District Magistrates to the complainants. The new arrangement will be instrumental for expeditious clearance of the D.D. or Cheque and also cut short the time hitherto taken for sending the e-mails to the complainants for submission and securing of affidavits which is a pre-requisite for transfer of recovered money. The new S.O.P. of U.P. RERA is useful for proper monitoring of entire process of transaction of money recovered through the District Magistrates. He also called upon the allottees to quickly file their affidavits so that the recovered amount is transferred in their accounts without delay.
